The effect of child custody arrangements on child support

On Behalf of Friley & Dugas, LLC | Aug 12, 2024 | Child Custody |

The main thing that determines child custody arrangements is the best interests of the child. Other factors include the child’s age, health, emotional ties with each parent, and each parent’s ability to provide for the child’s needs. Aside from these, parents need to understand the types of custody arrangements available. By doing this, they can prepare for the effects of child support.

Types of custody

Sole custody means one parent is primarily responsible for the care of the child. The non-custodial parent is usually required to pay child support. This helps cover the cost of the child’s living expenses, healthcare, education, and other needs. Child support guidelines determine the amount required after considering both parents’ incomes.

In joint custody arrangements, both parents share significant responsibilities for the child’s upbringing. However, this does not necessarily mean equal physical custody. One parent may still be the primary custodial parent, while the other has visitation rights. Child support is still required.

Calculating child support

Louisiana uses a specific formula to calculate child support obligations. These factors include the gross income of both parents, custody arrangement, and additional expenses. If there are significant changes in circumstances, the adjustment of child support orders may be necessary to best support the child.

Legal consideration and enforcement

Parents need to adhere to the terms of child custody and support orders. Failing to pay child support can lead to legal consequences. These may include wage garnishment, fines, and even imprisonment.

Navigating child custody and support

Understanding how these elements interact can help parents make informed decisions. Ensure that you follow legal processes correctly. This helps to create a stable and supportive environment for the child.
